A large majority of people seeking Family Law legal help initially seek a litigation attorney who is aggressive and willing to take their spouse for everything to enforce their custody, support and property division rights. Why, then, would a Certified Family Law Specialist with nearly 35 years of experience and an abiding passion for family law leave litigation entirely?
I abandoned litigation in 2008 because I recognized that it rarely serves families' true needs. Because it immediately sets up family members as adversaries, then quickly inflates feelings of anger, fear and helplessness; and because it doesn't encourage participants to take their past and present into consideration when considering their future.
But if litigation isn't used to resolve family law differences, what can be used?
With Collaborative Law most divorcing individuals quickly realize that, once their feelings of anger and lack of trust go away, they can see and pursue a solution that respects all participants' feelings and goals for their lives. The results are 1) agreements that truly satisfy and serve each participant, and 2) a positive process that rebuilds and changes relationship instead of destroying them.
